Second, did you try googling? Googling this kind of illegal stuff generally works out 100.1% of the time.

Jailbreaking isn't illegal... It just voids your warranty. But like he said, google. You didn't even give us a model version or anything. Look up a decent youtube video on how to jailbreak the ipod touch and you'll be solid.
